Terms of service

Skips LLC (“Skips”, “Company”, “we”, “us”, or “our”) owns and operates the website located at www.joinskips.com and other related websites and mobile applications with links to these Terms of Use (collectively, the “Site”). We offer online services enabling our members (“Members”) to order health products (“Products”) and to report their health history and engage healthcare professionals (“Providers”) to obtain medical, healthcare, wellness and pharmacy services (collectively “Services”).

By accessing and using the Site, you agree to be bound by these Terms of Use and all other terms and policies that appear on the Site. If you do not wish to be bound by these Terms of Use, you may not use the Site or the Services.

Licensed physicians, nurse practitioners, PAs and other healthcare professionals provide the Services. All of the Providers who deliver Services through Skips are independent professionals solely responsible for the services each provides to you. Skips does not practice medicine or any other licensed profession and does not interfere with the practice of medicine by any of the Providers, each of whom is responsible for their services and compliance with the requirements applicable to their profession and license.

If you receive a prescription as a result of the Services, you may select delivery to ship your prescription from one of our partner pharmacies or to collect your prescription yourself from one of the pharmacies listed in our Services (collectively, the “Pharmacies”). You consent to us sending the Pharmacies the information, health records and personal information (such as your name, location and demographic information) needed for you to receive pharmacy services.

None of the Site content (other than information you receive from Providers) should be considered medical advice or an endorsement, representation or warranty that any particular product, medication or treatment is safe, appropriate, or effective for you.

Skips provides various technologies and tools as part of its Services as a means of providing direct access to Providers for communication, consultations, assessments, treatment and pharmacy services, by messaging, telephone and other electronic means.

As with any health service, there are risks. In rare cases, information sent may not be enough for a Provider to make a decision; delays may occur if equipment fails; a lack of access to all of your health records may lead to drug interactions, allergic reactions or other errors; and security protocols could fail. No results can be guaranteed, and your Provider may decide the Services are not appropriate for some or all of your treatment needs.

Skips is required to maintain safeguards to protect the security of your health information. We devote considerable effort to ensuring that your personal information is secure, and our privacy protections are documented in our Privacy Policy.

Text messages. Skips asks for your mobile number to coordinate care. Providing your number, creating an account, or accepting these Terms does not enroll you in text messages. If you select “Yes, I agree” in the separate text message question in Skips website chat, Skips may text care updates to that number. You may select “No, continue in chat” and continue using Skips and receiving care through chat. We will not include medical details in these texts. For medical information, use secure chat in your Skips account.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. You can also contact hello@joinskips.com. We do not sell or share your mobile number or SMS consent data with third parties for marketing.

Email. Skips may email you about your account and use of the Services, including appointment reminders, service announcements, and administrative messages. You consent to receiving these service emails. Email may contain personal health information and may not be secure. Use secure chat for sensitive discussions.

When you register on the Site, you are required to create an account (“Account”) by entering your name, email address, mobile phone number and certain other information collected by Skips (collectively “Account Information”). You must be of legal age to form a binding contract and provide true, accurate, current and complete information. You may not share your Account or create more than one, except subaccounts for children of whom you are the parent or legal guardian, and you are responsible for keeping your Account access confidential and for all activity under your Account.

The Services are available for use by children, but the Member for all patients under the age of 18 must be the patient’s parent or legal guardian. If you register on behalf of a minor, you are fully responsible for complying with these Terms of Use.

We hereby grant to you a limited, non-exclusive, nontransferable right to access the Site and use the Services solely for your personal non-commercial use and only as permitted under these Terms of Use and any separate agreements you may have entered into with us (“Access Rights”). We may deny or suspend use of the Site or Services to anyone for any reason. You agree not to impersonate anyone, break any law, reverse engineer the Site, spread harmful code, or use abusive language or behavior when communicating with us or Providers.

You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. By providing a credit card or other payment method, you authorize Skips, our affiliates or our third-party payment processors to charge it for all fees due, with no additional notice or consent required.

Medication is paid for at the pharmacy. It is not included in the price of the Services and is billed and charged by the pharmacy separately.

Skips and the Providers do not accept health insurance and are not enrolled with federal or state health care programs such as Medicare and Medicaid. The Services are paid in cash, and you are responsible for their cost. We may change our pricing before billing you for any payment.

Skips offers a subscription-based membership plan, giving you access to care, 7 days a week. Your membership includes healthcare services such as consultations with Providers, prescription management, and the other benefits outlined in your plan.

Billing and payment. Membership fees are billed monthly, starting on the date of your initial subscription. Payments renew automatically each month unless you cancel. Membership fees are subject to applicable taxes, where required.

Cancellation. You can cancel anytime and your membership stays active to the end of the current cycle. To cancel, email hello@joinskips.com. There are no cancellation fees, and no refunds are issued for unused portions of a billing cycle.

Continuity of care. Your membership benefits stay active until your cancellation takes effect, so you have time to move your care without interruption.

Not health insurance. Skips membership is not insurance and is not a substitute for it, and it does not meet any creditable coverage requirements under any state law. It cannot be combined with federal or state-funded programs such as Medicare or Medicaid. It can be used in addition to any health insurance you already have.

From time to time, Skips may make certain Services available for purchase through the Site on a subscription basis. Your payment method will be charged automatically at the intervals described at checkout.

Subject to rights that cannot be waived under US law, a subscription charge can only be refunded when you ask to cancel before a consultation with a Provider has been completed, or when a product or pricing error is identified. Refunds go back to the payment method used for the original charge.

If you are not satisfied with the service you have received, would like to dispute a charge made to your account, or have any other concern about the service you received from us or a Provider, please let us know. We will act fairly and reasonably for both you and the Provider, investigate your concerns, and work to resolve them.

Based on the outcome, we may adjust the fee charged by the Provider (for example, where the service was insufficient or a technical error prevented it), or refund the fee charged by the Provider (for example, where a service was not provided). To request a refund, email hello@joinskips.com. Support is available 7 days a week.

Certain products available through the Site require a valid prescription by a licensed healthcare provider. You will not be able to obtain a prescription product unless you have completed a consultation with a Provider, the Provider has determined it is appropriate for you, and the Provider has written a prescription. You may fill it through one of the Pharmacies or at any pharmacy of your choice. Medication fees are not included in the price of the Services and are billed and charged by the pharmacy separately.

We will not be liable for any information, software, or links found at any other website, internet location, or source of information, nor for your use of such information, software or links, nor for the acts or omissions of any such websites or their respective operators.

The Site and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by US and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. These Terms of Use permit you to use the Site for your personal, non-commercial use only.

Certain of the names, logos, and other materials displayed on the Site or in the Services may constitute trademarks, trade names, service marks or logos (“Marks”) of Skips or other entities. You are not authorized to use any such Marks without the express written permission of Skips.

You may deactivate your Account and end your registration at any time, for any reason by sending an email to hello@joinskips.com. We may suspend or terminate your use of the Site, your Account or registration for any reason at any time. After termination, we have no further obligation to provide the Services, except to give you access to your health records or where Providers must continue your care under their legal, ethical and professional obligations.

We may at our sole discretion change, add, or delete portions of these Terms of Use at any time on a going-forward basis. Updates are posted on this page with a new effective date. Continued use of the Site or Services after notice of any such changes indicates your agreement to be bound by the revised Terms of Use.

You expressly agree that use of the Site or Services is at your sole risk. Both the Site and the Services are provided on an “as is” and “as available” basis without warranties of any kind.

Skips does not provide medical advice, diagnosis, or treatment. It is an online service and technology platform connecting patients with independent Providers, who are solely responsible for all medical services, advice and treatment decisions.

You understand that to the extent permitted under applicable law, in no event will Skips or its officers, employees, directors, parents, subsidiaries, affiliates, agents or licensors be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of revenues, profits, goodwill, use, data or other intangible losses arising out of or related to your use of the Site or the Services, regardless of whether such damages are based on contract, tort (including negligence and strict liability), warranty, statute or otherwise. Where the law does not allow us to limit our liability, our liability will be the minimum the law permits.

You agree to indemnify, defend and hold harmless Skips, its officers, directors, employees, agents, parents, subsidiaries, affiliates, licensors, and suppliers from and against any claim, actions, demands, liabilities and settlements, including without limitation reasonable legal and accounting fees (“Claims”), resulting from, or alleged to result from, your violation of these terms and conditions. You also agree to indemnify your Provider(s) against third-party Claims resulting from your not following their advice or recommendations.

All of the Providers are based in the United States, and we provide the Services for use only by persons located in the United States. Skips makes no representation that all products, services and/or material described on the Site, or the Services available through the Site, are appropriate or available for use in locations outside the United States.

These Terms of Use and your use of the Site shall be governed by the laws of the State of New York, United States of America, without giving effect to the principles of conflict of laws. Any dispute arising under or relating to these Terms of Use will be resolved exclusively by the New York courts, except that either party may bring a claim related to intellectual property rights, or seek temporary injunctive relief, in any court of competent jurisdiction.
